General Terms and Conditions of Sale and Delivery for the PIN–UP HOME 

General Remarks

These general terms and conditions of sale and delivery (“Terms of Sale”) apply to your purchase of PIN–UP HOME products and services from PIN–UP HOME in the United States at the PIN–UP HOME Online Shop located at www.pinuphome.com. If you are purchasing at the PIN–UP HOME Online Shop, you must agree to these Terms of Sale and indicate your agreement by clicking on the “I agree” button. If you do not agree with these Terms of Sale, click “I do not agree” and you will not be able to purchase PIN–UP HOME products online. By clicking on the “I agree” button, you acknowledge that you have reviewed and consent to be bound by these Terms of Sale.

Together with the description of PIN–UP HOME products and services stated in your order, these Terms of Sale constitute the entire agreement between you and PIN–UP HOME for your purchase of PIN–UP HOME products. No amendment to these Terms of Sale shall be effective unless agreed upon in writing by you and PIN–UP HOME.

 

Purchase Orders

Your order of a PIN–UP HOME product only constitutes an offer to buy from PIN–UP HOME in accordance with these Terms of Sale. PIN–UP HOME reserves the right to accept or reject any order in its sole discretion. PIN–UP HOME does not guarantee that any product or service listed on the website will be available for purchase.

Upon receipt of your order, PIN–UP HOME will send you an automated order confirmation that lists the details of your order. Your order is accepted by PIN–UP HOME and a contract on the sale and delivery of the product is considered to have been formed only upon PIN–UP HOME sending you a written order confirmation. The order confirmation does not have to be signed by PIN–UP HOME and may be transmitted by e-mail.

Once you have submitted an order, you may submit a request to make changes to your order, but such changes will not take effect unless PIN–UP HOME provides written or electronically transmitted acceptance of your request. All offers of PIN–UP HOME in the Online Shop are only available in quantities suitable for an average household per order and per product in the case of several orders.

 

Prices and Delivery Costs

All prices for orders submitted through the PIN–UP HOME Online Shop are based on the prices that are listed on our website at the time of your purchase. PIN–UP HOME reserves the right to list different prices for purchases in-store and in the Online Shop.

Unless expressly otherwise indicated in writing, our listed prices do not include any additional costs or expenses associated with your order, including without limitation the cost of transport, delivery, special handling, storage, insurance and assembly.

PIN–UP HOME may be obligated to collect state, federal or provincial sales, use, excise or similar taxes or duties from you for the sale of products and/or services to you in addition to the prices quoted. Where PIN–UP HOME is not so obligated, you shall report and pay any and all taxes (including any sales, use, excise or similar taxes) fees, duties and other charges imposed currently or in the future with respect to the purchase, shipment, delivery, installation, assembly, storage, or use of any of the products you purchase, and indemnify, defend and hold PIN–UP HOME harmless therefrom.

 

Payment Terms

Unless otherwise agreed, all orders shall be paid at the time of purchase and prior to delivery, and all payments and other financial requirements under your order shall be in the currency of the United States and made by credit card.

By submitting credit card information, you represent and warrant that you are at least eighteen years of age and have the legal authority to use the credit card that you submit for payment, and you authorize our use of such information in accordance with our Privacy Policy, including without limitation our provision of such information to third parties for the purposes of payment processing. Because PIN–UP HOME uses a third-party payment processor to process credit card payments on our behalf, when you supply payment information in connection with a purchase you agree that PIN–UP HOME is not responsible for the security of such information when it is in the control of the third-party payment processor.

 

Delivery; Transfer of Ownership

Delivery dates are only binding if PIN–UP HOME has expressly agreed to them in writing. Otherwise, any delivery dates indicated on the website or on any order or other document provided by PIN–UP HOME are estimates only. Delays in delivery do not entitle you to refuse to accept the product, to cancel your order or to claim damages. Partial deliveries are permitted and do not entitle you to refuse to accept the product.

You will be contacted by PIN–UP HOME or a third party engaged by PIN–UP HOME prior to delivery in order to set the delivery time.

If PIN–UP HOME or the third party engaged by PIN–UP HOME is not able to deliver your order at the time agreed with you to make the delivery because the delivered product(s) do not fit into any entrance, doorway or stairs, because you are not present at the agreed time or you otherwise refuse delivery, you will be required to bear all costs incurred in connection with any subsequent transfer, restocking, storage and delivery of the product(s).

 

Benefit and Risk

Benefit and all risk of loss or damage to any product you order passes to you when the product is delivered to you.
